Position Overview:

The Contract and Claim Manager is an integral member of the ATMS Upgrade Project team in Miami, Florida. With a background in construction/contracts/commercial projects in a corporate environment or law firm, this role benefits from knowledge of Florida infrastructure projects. Ideally, you will have a sophisticated understanding of contract and claim management concepts to assist in negotiating terms and conditions with customers and other parties such as subcontractors and suppliers, outline terms of service and project deliverables, and effectively handle incoming and outgoing claims. Your work will support procurement, supplier contracts, construction and design contracts, as well as licensing agreements. Proven leadership, technical, interpersonal, and communication skills, and a consistent record are crucial to success in this position.

This role has primary responsibility for the operative and strategic management of contracts, claims, and project changes. In collaboration with Yunex legal function in the US, the Contract and Claim Manager provides advice to the project management team and approvals, where required, during procurements and contract negotiations and throughout project execution. Specific responsibilities include drafting various documents such as notices and claims to secure the project's success and ensure compliance with the company's contractual obligations. The ability to effectively explain the topics above to the business partners and drive potential issues to a consensus decision is of the essence when performing the role.

Detailed Responsibilities:
  • Analyze and resolve a diverse range of matters varying in complexity with government agencies, commercial customers, partners, suppliers, and subcontractors.
  • Participate in negotiations and prepare legally binding documents.
  • Identify and assess the primary contractual risks, opportunities, and requirements and communicate within the project team.
  • Collaborate with internal parties to define the contract strategy.
  • Liaise with technical and financial staff, sub-contractors, legal teams, and the customer's representatives.
  • Establish a system for incoming and outgoing claims by identifying claim possibilities to customers and suppliers.
  • Supervise documentation and provide supporting evidence to each event.
  • Ensure that communications are drafted, reviewed, aligned, and sent in a timely matter to the involved partners.
  • Prepare contract concepts and defense strategies.
  • Prepare and implement Contract & Claim Workshops / Contract Readings with the project team.
  • Consult with management and draft official correspondence towards the customer and suppliers/subcontractors in a timely, transparent, and professional manner.
  • Develop risk mitigation and settlement strategies and negotiate/finalize settlement agreements where necessary.
  • Monitor contract conditions and events (duration, consequences, losses), deadlines, landmarks, and contract-related correspondence and act accordingly.
  • Undertake the task to rationalize and provide legal support on other issues that may constitute opportunities.
  • Defend against external claims from customers, partners, suppliers, and subcontractors through the presentation of relevant exonerative facts and documentation.
  • Prepare, participate and post-process claim negotiations
  • Develop project-specific procedures in your area of expertise and review other quality procedures that involve contractual issues.
  • Conduct legal research and writing, and provide ongoing legal support within the territory.
  • Develop and provide legal/compliance training to the team, coach team members and work with corporate executives to ensure adherence to corporate policies and guidelines.
  • Control all claim-relevant issues and the data administration in the project to control and report progress and events to relevant partners.
Requirements:
  • Advanced degree in Engineering or Business Administration with relevant work experience in contract management with legal domain for US infrastructure and governmental projects. JD and an active license to practice law in the State of Florida, helpful.
  • Appropriate experience as a contract manager for US infrastructure and governmental projects.
  • Minimum of five (5) years in progressively responsible positions with construction/contracts/commercial transactions in a law firm or a corporate environment.
  • Proven track record in commercial transactions and litigation.
  • Excellent professional, legal, written and verbal communication, and negotiation skills.
  • Good understanding of the market conditions and project execution in South Florida.
  • Ability to produce quality materials within tight timeframes and simultaneously lead several assignments, prioritizing as necessary to ensure timely delivery.
  • Specialized skills and proficiency with project/program control software and web-based program management systems.
