Position Overview

We are seeking a Head of Contract and Claim Management to join and support the Rolling Stock business in Sacramento, California. Ideally, you will have knowledge of government procurement and contracts, are able to negotiate and manage a variety of contract types, can prosecute and defend contract claims, and support procurement by advising on, negotiating, and drafting supplier contracts. You will have experience with successfully developing and implementing process improvement. You will have validated leadership, technical, organizational, and communication skills. Siemens Mobility operates in a highly regulated industry, and familiarity with federal regulations in respect of DOT, FRA, and FTA is a plus.

We are responsible for the strategic management of contracts as well as claims and disputes that may arise in connection with those contracts. As part of our team, you will be responsible for coordinating claim activities and ensuring consistent approaches across the Siemens Mobility businesses. In addition, this role is responsible for implementing improvements to our contracts and claim management. In addition, you will provide contract and claim advice during public procurements and contract negotiations, as well as throughout project execution, including the ability to draft claims, position papers, and other legal documents. The ability to efficiently and practically explain contract topics to our business partners and drive potential issues to a consensus decision is essential.

Preferred Experience

  • Law degree (admitted to practice in a U.S. or foreign jurisdiction) and/or significant contract management experience
  • Experience in preparing and defending claims against/from customers and suppliers
  • Experience supporting the development of other contract managers
  • Excellent claim drafting and defense skills are necessary to effectively perform the job requirements
  • Validated experience in identifying risks and opportunities
  • Ability to deliver high-quality contract advice and draft related correspondence within tight timeframes and simultaneously handle ongoing assignments

Detailed Responsibilities

  • Work as the primary contract manager on complex projects
  • Coordinate with other businesses within Siemens Mobility (e.g., Rail Infrastructure and Customer Service) to help drive business-wide changes to contracts and claim management
  • Support the development of process improvements to strengthen claims identification and prosecution
  • Advise Rolling Stock management on claim viability, prosecution, and defense
  • Lead Claim Steering Committee
  • Analyze, evaluate, and resolve diverse matters with customers, partners, and suppliers
  • Provide guidance, support, and training to other members of the contract management team
  • Identify and drive the project team to successfully assert and avert claims
  • Identify and assess the contractual risks, opportunities, and requirements, and communicate the same
  • Cooperate with the project management team to define the contract/legal strategy for projects
  • Consult with management and draft official correspondence towards public owners and suppliers in a timely, clear, and professional manner
  • Defend against external claims from customers, partners, and suppliers through the presentation of relevant exonerative facts and documentation
  • Prepare for and participate in claim negotiations as well as pre-litigation matters together with project management
  • Conduct legal research and writing

The pay range for this position is $184,008 - $216,444 annually with a target incentive of 15% of the base salary. The actual wage offered may be lower or higher depending on budget and candidate experience, knowledge, skills, qualifications, and premium geographic location.
